What's Happening with Portuguese Nationality Law
The Current Situation
On October 28, 2024, the Portuguese Parliament approved amendments to the Nationality Law (Lei n.º 37/81) with 157 votes in favor and 64 against. The key change: increasing the minimum residency requirement from 5 years to 10 years for most foreign nationals (7 years for EU and CPLP citizens).
However, this law is not yet in force.
On November 18, 2024, the Socialist Party (PS) submitted a constitutional challenge signed by 50 deputies. The Constitutional Court registered the case on November 19 and must rule within 25 days — placing the expected decision around December 13-14, 2024.
Until the Court rules and the President promulgates the law, the current 5-year requirement under Article 6, n.º 1, alínea b) remains fully in effect. No transitional provisions have been announced.

Your Residency Clock Started Earlier Than Your Card Arrived
Here's what many applicants don't realize: under Article 15, n.º 4 of the current Nationality Law (introduced by Lei Orgânica n.º 1/2024, effective April 1, 2024), your legal residency period begins counting from the date you submitted your residence visa application — not from when you received your residence permit card.
This matters enormously given current processing realities. AIMA (the Portuguese immigration agency) has approximately 400,000 pending cases. Many applicants wait 12-24 months between application and card issuance.
Under the current law, that waiting time counts toward your 5 years.
Practical Example
Timeline for a D7 Visa holder:
- • Visa application submitted to VFS/Embassy: February 2020
- • Arrived in Portugal with visa: June 2020
- • Residence card finally issued: November 2021
- ✓ 5 years complete under CURRENT law: February 2025
- • 5 years if counted from card issuance: November 2026
- • 10 years under PROPOSED law: February 2030

Golden Visa Holders: Your Path to Citizenship
If you obtained Portuguese residency through the Golden Visa program, you have full eligibility for citizenship by naturalization — regardless of how much time you've physically spent in Portugal.
Your Time Counts
Golden Visa residence time fully counts toward the 5-year nationality requirement.
Minimal Stay is OK
The 7-day (year 1) and 14-day (years 2-5) requirements don't affect your nationality eligibility.

Is the 5-year rule still in effect?
Yes. As of December 2024, the proposed 10-year requirement has not been promulgated into law. The Constitutional Court is reviewing the legislation, and President Marcelo Rebelo de Sousa has stated he will await their ruling. Until the new law is published in Diário da República, the current 5-year rule remains in full force.
When will the Constitutional Court announce its decision?
The Court must rule within 25 days of the November 19, 2024 registration date. A decision is expected around December 13-14, 2024. However, even after the Court rules, the President must still decide whether to promulgate the law.
Does my Golden Visa residency time count toward citizenship?
Yes, fully. Time under Golden Visa residence authorization counts toward the 5-year nationality requirement. The minimal physical presence requirements don't affect your nationality eligibility. If you received your Golden Visa in 2019 or 2020, you may already qualify.
I submitted my visa application in 2020, but my card wasn't issued until 2022. When does my 5 years start?
Under Article 15, n.º 4 of the current law, your residency period counts from when you submitted your visa application — not from when you received your card. In your example, the 5 years would count from 2020.
What if I apply for citizenship now and the new law passes during processing?
Nationality applications are generally evaluated under the law in force at the time of submission. This is an important reason to assess your eligibility promptly. Specific legal advice depends on your individual circumstances.
Do I need to speak Portuguese to become a citizen?
Yes, you need to demonstrate A2-level Portuguese proficiency through a certified test. Exception: Nationals of CPLP countries (Brazil, Angola, Mozambique, etc.) are exempt from the language requirement.

Can I keep my current citizenship if I become Portuguese?
